Terms & Conditions – Retail & Workshop

1. About Us
These Terms & Conditions apply to all purchases and services provided by Bike Station Ballater Ltd, both online and in-store at our premises in Ballater, Aberdeenshire.
By purchasing goods or services from us, you agree to these terms.

2. Products & Availability
All products are subject to availability. We reserve the right to:
• Withdraw products without notice
• Substitute equivalent items where necessary
• Correct errors in product descriptions or pricing
Images are for illustration only. Specifications may vary slightly due to manufacturer updates.

3. Pricing & Payment
All prices are in GBP (£) and include VAT where applicable.
We accept:
• Amex, Debit & Credit Cards
• Stripe, PayPal, Klarna (where available)
• In-store payments
We reserve the right to cancel or amend orders due to pricing or stock errors.

4. Communication
For efficiency and accurate record-keeping, all customer service requests, issues, and queries should be made via WhatsApp to 07552 168263.
We cannot guarantee tracking or response to requests made via phone calls, voicemail, or informal channels.

5. Online Orders
5.1 Order Acceptance
Order confirmation does not constitute acceptance. We may cancel orders due to:
• Stock discrepancies
• Pricing errors
• Suspected fraudulent activity
5.2 Delivery
Delivery times are estimates only. We are not liable for courier delays.
Risk transfers to the customer upon delivery.

6. Click & Collect
• Orders must be collected within a reasonable timeframe
• ID and proof of purchase may be required
• We reserve the right to cancel uncollected orders after reasonable notice

7. Returns & Refunds
7.1 Online Purchases
Under UK Consumer Contracts Regulations, you may return goods within 14 days of receipt.
Items must be:
• Unused
• In original packaging
• In resaleable condition
Return postage is the customer’s responsibility unless the item is faulty.

7.2 In-Store Purchases
We do not offer refunds for unwanted in-store purchases.
Exchanges or credit notes may be offered at our discretion.

7.3 Non-Returnable Items
Unless faulty, the following are non-returnable:
• Used bikes or components
• Special order items
• Workshop consumables (e.g. sealant, lubricants once opened)
• Gift cards

8. Faulty Goods & Warranty
Your statutory rights under the Consumer Rights Act 2015 are not affected.
We will offer repair, replacement, or refund where goods are faulty.
Warranty exclusions include:
• Wear and tear
• Crash damage
• Poor maintenance
• Water ingress or environmental damage
• Modifications, including e-bike derestriction or tampering
Any modification to an e-bike system (including speed restriction changes) will void manufacturer warranty and may invalidate insurance and legal compliance.

9. Bicycles & Safety
Customers are responsible for:
• Selecting the correct bike size and specification
• Maintaining the bike appropriately
• Using the bike in accordance with manufacturer guidance
We strongly recommend regular servicing.
We accept no liability for injury or damage resulting from misuse, negligence, or failure to maintain equipment.

10. Workshop Services
10.1 Estimates
Service estimates are indicative only. Additional work may be required and will be communicated where possible.
10.2 Authorisation
By leaving your bike with us, you authorise us to carry out agreed work and any essential safety-related repairs.
10.3 Collection & Storage
• Bikes must be collected promptly once work is complete
• We reserve the right to charge storage fees after 7 days
• Bikes left uncollected for extended periods may be disposed of to recover costs (with reasonable notice)
10.4 Pre-Existing Issues
We are not responsible for:
• Hidden faults
• Previously damaged or worn components
• Issues arising from poor prior maintenance

11. Special Orders
Special order items:
• Require a deposit or full payment upfront
• Are non-refundable unless faulty

12. Gift Cards
Gift cards:
• Are non-refundable
• Cannot be exchanged for cash

13. Liability
To the fullest extent permitted by law, Bike Station Ballater Ltd shall not be liable for:
• Indirect or consequential losses
• Loss of earnings, business, or enjoyment
• Delays outside our control
Nothing in these terms excludes liability for death or personal injury caused by negligence.

14. Data Protection
We handle personal data in accordance with UK GDPR.
Customer communications (including WhatsApp) may be used to manage bookings, orders, and service records.

15. Governing Law
These Terms & Conditions are governed by the laws of Scotland.
